Katy Perry was feeling blue at the Grammys, matching her blue hairstyle to a light-blue, long-sleeved Elie Saab gown. "One of my absolute favorites of the night was Katy Perry," Celebuzz producer Rachel Maresca told MTV News. "She paired her bold, blue hair with a very light-blue Elie Saab lace gown. (AP) ? The ancient Chinese exercise of tai chi improved balance and lowered the risk of falls in a study of people with Parkinson's disease.

Symptoms of the brain disorder include tremors and stiff, jerky movements that can affect walking and other activities. Medications and surgery can help, and doctors often recommend exercise or physical therapy.

Tai chi (ty-CHEE'), with its slow, graceful movements, has been shown to improve strength and aid stability in older people, and has been studied for a number of ailments. In the latest study, led by Fuzhong Li of the Oregon Research Institute in Eugene, tai chi was tested in 195 people with mild-to-moderate Parkinson's.

The participants attended twice-weekly group classes of either tai chi or two other kinds of exercise ? stretching and resistance training, which included steps and lunges with ankle weights and a weighted vest.

The tai chi routine was tailored for the Parkinson's patients, with a focus on "swing and sway" motions and weight-shifting, said Li, who practices tai chi and teaches instructors.

After six months of classes, the tai chi group did significantly better than the stretching group in tests of balance, control, walking and other measures. Compared with resistance training, the tai chi group did better in balance, control and stride, and about the same in other tests.

Tai chi training was better than stretching in reducing falls, and as effective as resistance training, the researchers reported. The improvements in the tai chi group continued during three months of follow-up.

Li said the study showed tai chi was safe. It's easy to learn, and there's no special equipment, he added.

"People are looking for alternative programs, and this could be one of them," he said.

Estimates vary, but at least 500,000 people in the United States have Parkinson's.

The findings are in Thursday's New England Journal of Medicine. The study was paid for by the National Institute of Neurological Disorders and Stroke.

Dr. Chenchen Wang, who is studying tai chi for arthritis and fibromyalgia, said the results of the Parkinson's research were "dramatic and impressive." She heads the Center for Complementary and Integrative Medicine at Tufts Medical Center in Boston.

One of the study's strengths: Researchers could measure the results directly instead of relying on the patients' own reports, she said. But a placebo effect can't be totally discounted, she said, since the participants knew which exercise program they were assigned and that could have influenced results.

TEMPE (Feb. 6, 2012) - As an ice age crept upon them thousands of years ago, Neanderthals and modern human ancestors expanded their territory ranges across Asia and Europe to adapt to the changing environment.

In the process, they encountered each other.

Although many anthropologists believe that modern humans ancestors "wiped out" Neanderthals, it's more likely that Neanderthals were integrated into the human gene pool thousands of years ago during the Upper Pleistocene era as cultural and climatic forces brought the two groups together, said Arizona State University Professor C. Michael Barton of the Center for Social Dynamics and Complexity and School of Human Evolution and Social Change.

"The traditional story in textbooks doesn't fit well with what we know about hunter-gatherers. For the most part, they don't like to go far from home. It's dangerous," Barton said.

Barton and Julien Riel-Salvatore of the University of Colorado Denver, present new research in the journal, Advances in Complex Systems, that the Neanderthals demise was due to a combination of influences, including cultural changes. The paper titled, Agents of Change: Modeling Biocultural Evolution in Upper Pleistocene Western Eurasia, appears online in January. It builds on work published last year in the journal Human Ecology and on recent genetic studies that show a Neanderthal contribution to the modern human genome.

"How a culture's working knowledge is passed on is as important as biological information for human evolution," Barton said. "There is a perception that biological evolution determines culture during the Pleistocene era and that cultural influences predominate afterwards (including today). The reality is that the two forces have been working together and they were as important 50,000 years ago as they are today."

The researchers used archaeological data to track cultural and socio-ecological changes in behavior in Western Eurasia during the past 120,000 years. As Neanderthals and early humans land-use patterns shifted during the last ice age, computer modeling showed that the two populations began to interact and mate, leading to the "extinction" of one of the groups due to hybridization, a well-recognized phenomenon in conservation biology. Neanderthals were limited to western Eurasia and usually it is the smaller population that becomes "extinct" in this way. Nevertheless, succeeding hybrid populations still carry genes from the regional group that disappeared, according to the researchers.

To address the possibility that the two groups would not have seen one another as potential mates, the researchers also examined the possible impacts of social barriers to mating in their models. They found that unless social taboos were nearly 100 percent effective, it would have not made any difference in outcomes over time as the gene pools mixed, Barton said.

"This is one of the first attempts to explicitly address the impact of various degrees of social avoidance on possible hybridization between the two groups," added Riel-Salvatore.

"Other than the fact that they disappeared, there is no evidence that Neanderthals were any less fit as hunter-gatherers of the late Pleistocene than any other human ancestor living at that time. It looks like they were as capable as anyone else," Barton said.

Barton and Riel-Salvatore studied the stone artifacts that were left behind by these ancient peoples to track the movement patterns among hunter-gatherers across western Eurasia during the Pleistocene era.

"Stone technology is completely different than the kind of technology we have today," Barton said. "But it can tell us important things about land use, how people organized themselves and how they moved to access resources to live."

These tools provide insight into Neanderthals' lives and gene sequencing tells the story of their legacy.

"Recent sequencing of ancient Neanderthal DNA indicates that Neanderthal genes make up from 1 to 4 percent of the genome of modern populationsespecially those of European descent," Riel-Salvatore said. "While they disappeared as a distinctive form of humanity, they live on in our genes. What we do in this study is propose one model of how this could have happened and show that behavioral decisions were probably instrumental in this process."

The researchers suggest it's time to study variation and diversity among individuals rather than classify them into types or species.

"Neanderthals' legacy lives on in our biological genome and possibly in our cultural knowledge," Barton added. "There may have been may other populations like Neanderthals who were integrated into a global human species in the Late Pleistocene. We're the results."

"Other than the fact that they disappeared, there is no evidence that Neanderthals were any less fit as hunter-gatherers of the late Pleistocene than any other human ancestor living at that time. It looks like they were as capable as anyone else," Barton said.

Barton and Riel-Salvatore studied the stone artifacts that were left behind by these ancient peoples to track the movement patterns among hunter-gatherers across western Eurasia during the Pleistocene era.

"Stone technology is completely different than the kind of technology we have today," Barton said. "But it can tell us important things about land use, how people organized themselves and how they moved to access resources to live."

These tools provide insight into Neanderthals' lives and gene sequencing tells the story of their legacy.

"Recent sequencing of ancient Neanderthal DNA indicates that Neanderthal genes make up from 1 to 4 percent of the genome of modern populationsespecially those of European descent," Riel-Salvatore said. "While they disappeared as a distinctive form of humanity, they live on in our genes. What we do in this study is propose one model of how this could have happened and show that behavioral decisions were probably instrumental in this process."

The researchers suggest it's time to study variation and diversity among individuals rather than classify them into types or species.

"Neanderthals' legacy lives on in our biological genome and possibly in our cultural knowledge," Barton added. "There may have been may other populations like Neanderthals who were integrated into a global human species in the Late Pleistocene. We're the results."

Mexican aid lags for starving Tarahumara Indians (AP)

GUACHOCHI, Mexico ? It's been months since Maria Luisa Gonzalez and her husband have been able to harvest anything from their drought-parched land or catch fish in a lake that's become little more than a muddy puddle.

Like other Tarahumara Indians suffering from severe drought in Mexico's vast northern canyons, Gonzalez said she had yet to receive any aid last week, nearly two months after President Felipe Calderon said that he had assessed the drought's damage and his government was tending to the crisis.

The federal Interior Department declared a state of emergency in 37 Sierra Madre municipalities in the Tarahumara region on Jan. 3.

The first major batch of federal help showed up Thursday with great media fanfare, including Calderon and First Lady Margarita Zavala loading a navy plane with boxes of groceries on a rural landing strip in Chihuahua state, where the Tarahumara live in the crannies of a natural wonder that dwarfs the Grand Canyon.

"I want to emphasize the Sierra Tarahumara is a top priority in my administration," Calderon said in a press conference, adding that the navy was delivering 119 tons of food.

Gonzalez, however, said such promises have been empty since their October crops yielded no corn potatoes or beans.

"We hadn't received anything," the 67-year-old said. "If this continues, we will starve to death because what are we going to eat? It's dry. The lake is dry."

Calderon first said Dec. 1 that his government was on top of the crisis, caused by the worst drought to hit northern Mexico in 70 years. A trip to the region late last by The Associated Press showed families picking up private donations but nothing from the government. Even Chihuahua officials say the response has been slow.

"They took a long time," said Jesus Velasquez, coordinator of a program delivering state resources to the Tarahumara. He also coordinates the food relief efforts with the navy and private groups. "There wasn't a federal program until now, until the president came. We still need to know how much," he said,

The federal government issued a statement Saturday responding to AP questions showing Calderon delivering food and blankets on Nov. 30. "The support has intensified since January, incorporating the army and the navy," the statement said.

The federal Social Development Department began distributing boxes with 10 kilos of food each in 107 shelters in the region on Jan. 24. Deputy Secretary Luis Mejia told the AP that sending food took time because officials could only plan logistics after the state of emergency was declared.

Meanwhile, the plight of the Tarahumara has become an easy photo op, as well as a convenient button to push in an election year for Mexicans, who draw pride from their indigenous groups as well as embarrassment when reminded how poorly they live.

The town is only an hour away from Guachochi, the state distribution center for aid to 250,000 Tarahumara in the Sierra Madre mountains. Before the federal push last week, the AP saw no signs of a major relief effort under way. State officials say they've been distributing help since November and still have only reached half of the 70,000 needy families. The 110 pounds of corn, 44 tons of beans and four tons of pork given to each family only last about a month, and his aid workers are supposed to make another round of deliveries when the food runs out.

Even with the arrival of trucks and planes of supplies, it's still difficult to reach people who live in the canyons, which are only accessible by foot or horse.

"There are thousands of communities," Velasquez said. "We can't reach all of them."

The Tarahumara face shortages in food every winter because of the cold, harsh terrain they inhabit, and many migrate to the cities for the winter where they live on the streets. Malnutrition among the population is high, and the Health Department said in a 2009 document that the infant mortality rate among the Tarahumara was 95 out of 1000, more than five times Mexico's average rate, mostly because of malnutrition.

In the last year, their living conditions have grown much worse with the extreme drought.

The outpouring of aid began when the council secretary in the Chihuahua town of Carichi told a local television channel Jan. 15 that some Tarahumara were jumping off cliffs because they were desperate that they couldn't feed their families.

The aid didn't stop even after the state government of Chihuahua, the Mexican Red Cross and other officials said the reports were false.

Tomas Ruiz, representative of the board of governors in Tarahumara regions, said the aid is only arriving to the larger and more accessible villages of the Sierra Madre so officials can publicize the good deeds.

"We need the food, but it is not the solution to what we want," Ruiz said. "What we want is a policy that really helps us come out of poverty, marginalization, isolation."

Guadalupe Bustillos, 45, said some days the only nourishment for her and her husband has been a glass of corn mush called "pinole." When she saw an aid truck pull over last week, she was able to get a garage bag full of water, rice, tuna and used clothes from Topos.

Besides the state efforts, the Red Cross boosted food aid to that region from the five tons they normally deliver during the winter to 300 tons of canned food arriving in train cars in the past weeks.

Velasquez has received the food aid in the town of Guachochi, called the center of the Sierra Tarahumara, where state aid trucks sporadically arrive after hours of navigating narrow tracks of curvy mountain roads.

On a recent day, dozens of indigenous mulled around the patio of a house in Laguna de Aboreachi where the trailer parked with the food. Mothers breast-fed babies fastened to their bodies with hand-woven shawls while waiting in line to get packages of food and water bottles.

The lake of Aboreachi, where some residents used to fish for trout, is now a muddy pit. The lumber yard that used to employ indigenous residents has closed.

Macario Gomez, transportation director of the regional Mexican Red Cross, said he has seen a mobilization on behalf of the state of Chihuahua like no other year with more than 1,000 metric tons of food delivered.

"The Sierra is the Achilles' heel of the state government," Gomez said.

Even with the aid, Gomez said, he is seeing increasingly more Indians walking five to six hours only to get some grain and water. He said some have to leave with their hands empty.

But unless I?m willing to settle for one of those ubiquitous ?Big Game? sales, I?ll probably be forced to stick with?what I?ve got.

Every year, while every sports yak in America is obsessing over Super Bowl scouting reports, every business in America is trying to capitalize on the game. But most of them aren?t using the words ?Super Bowl? to do so, and the reason is fairly obvious: the phrase ?Super Bowl? is trademarked by the NFL, which is famously protective of its intellectual property. Courts recognize that it?s virtually impossible to refer to particular products or services without using protected trademarks ? how can I review the new Apple iPad without using the words ?Apple? or ?iPad?? That?s why the law allows the public to freely use a protected trademark nominatively, i.e., to?describe the product or service underlying the mark, often in the only way that makes any sense. We lawyers call this idea the ?nominative fair use? doctrine. And it applies even where the speaker?s goal in using the mark is to describe and promote?its own products or services.

The Ninth Circuit (which covers California and much of the western United States) uses a three-part test for nominative fair use: (1) the product or service in question must be one not readily identifiable without use of the trademark; (2) only so much of the mark may be used as is reasonably necessary to identify the product or service; and (3) the user must do nothing that would, in conjunction with the mark, suggest sponsorship or endorsement by the trademark holder. And while the particular facts are always vital in any intellectual property dispute, most of our beleaguered ?Big Game? companies could probably pass this test.

The Super Bowl is the Super Bowl. Sure, you could call it the ?NFL Championship Game,? but the law doesn?t require you to go out of your way to make some oblique reference to something that is principally readily identifiable only by its trademarked name. Which means that, as long as companies are careful in their advertising to respect factors 2 and 3 of the Ninth Circuit?s nominative fair use test ? not using words like ?official? that suggest NFL sponsorship or endorsement, avoiding the use of prominent logos or other NFL regalia, not making the words ?Super Bowl? dwarf the name of their own product/service in size and/or prominence, and probably including a few decently prominent disclaimers (?this program/promotion is not in any way affiliated with or endorsed by the NFL or its teams?) for good measure ? they can probably pass the nominative fair use test. In other words, throw a Super Bowl party, hold a Super Bowl sale, and dispense with this?wink wink nudge nudge nonsense. And the case is even stronger for those who don?t want to go as far as tagging their event or promotion with the words ?Super Bowl,? but simply convey factual information like, ?We guarantee your new TV will arrive before the Super Bowl.? (At present, many retailers are too scared to say even that.)

So If It?s That Easy, Why Doesn?t Everybody Do It?

You may now be saying to yourself, ?Unless this blogger is some kind of genius with never-before-heard-of legal insight [I?m not, but thank you], why isn?t everyone using the phrase ?Super Bowl? just like he says instead of cowering behind these ?Big Game? euphemisms?? Because sometimes,?being legally right only matters if you can afford to prove it.

By most accounts, the NFL?s annual ?Super Bowl? enforcement campaign doesn?t discriminate among business big and small, national and local, or even for-profit and non-profit. (Case in point: the Internet features?several ?how to??guides for?churches that want to throw?not-calling-them-Super Bowl parties without getting sued. But before you think the NFL is uniquely evil in this regard, remember that, in 1996,?performing rights organization ASCAP sued the Girl Scouts for unlicensed jamboree sing-alongs. Which is to say, the NFL is?non-uniquely evil.) And when it sends out its annual volley of aggressive cease-and-desist letters claiming egregious trademark infringement and irreparable harm, the NFL isn?t worried about nominative fair use doctrine because, at least to date, it hasn?t been worth anybody?s time and money to fight them on it.

If you?re a small business owner, you don?t have the time, the resources, or the inclination (especially the resources) to be the legal test case/martyr and fight the good fight for harassed business owners everywhere. It?s just easier to use some ?Big Game?-like euphemism and spare yourself the headache. That?s no less true for the big guys who could afford to fight the NFL on the battleground of nominative fair use ? it?s just cheaper and easier to use some phrase that, at least in the weeks immediately before the Super Bowl, consumers have been effectively trained to decipher well enough for the company to get its point across.

Of course, if the NFL had its way, these companies would even be denied the refuge of the ?Big Game.? In 2006, the NFL tried to trademark the phrase ?Big Game? too,?finally dropping the effort only after?Cal and Stanford politely reminded the NFL that the schools? annual rivalry football game had borne that moniker for more than 100 years. That, and the fact that?they were trying to trademark the phrase ?Big Game,? for crying out loud.

(Analysis of whether the NFL would be effectively shooting itself in the foot by stamping out the free publicity and widespread excitement generated for their marquee event by all this ancillary corporate advertising is a topic for a business blog, not a legal blog. But for what it?s worth, my answer would be, ?You?re damn right, they would be.?)

The Law Is What It Is?Unless It Is What I?Say It Is

I could end the discussion there, and you would probably leave this post properly indignant about the NFL?s overreaching legal posture. But as I often say, if the law were that simple, I wouldn?t have a job.

Remember, consumer understanding (and confusion) are the core concern of trademark law ? the test for trademark infringement is whether consumers are likely to be confused as to the source of a good or service bearing an allegedly infringing mark. And the NFL?s aggressive protection of its ?Super Bowl? trademark is no secret. Because the NFL is?so notoriously overprotective of that phrase, the general public may have been trained to believe that anything remotely commercial that actually uses the words ?Super Bowl? is NFL-sponsored, sanctioned, or affiliated. In other words, because people?s assumptions and understandings have adapted to the NFL?s practices (even if those practices don?t reflect the actual law), the law?may have functionally changed to match the NFL?s position because people who see ?Super Bowl? in commercial settings?might actually be confused about NFL affiliation (exactly the harm that trademark law is intended to prevent).

Did I just hear the distant sound of your mind being blown?

This fascinating paradox isn?t specific to the Super Bowl context. The same argument is sometimes raised with respect to the ?culture of clearance? around major movie studios and networks. Studios and networks are known to clear (that is, get a license for) virtually everything that appears on screen, even things they probably don?t need to clear (particularly on the trademark side, which is, for reasons that don?t warrant discussion here, arguably less demanding in this context than copyright law). But many people?know that studios and networks clear everything, so if they see a recognizable brand on screen, they might assume that it was cleared, or even that it was a paid product placement. So again, we have a potential risk of consumer confusion, which means the law may have functionally changed as a result of the major players? widely-known business practices.

Of course, this is all purely theoretical ? as far as I know, no one has ever tested these arguments in court, or even verified whether the type of consumer confusion I?m postulating here is real. But even if such confusion exists, there are compelling reasons why these arguments should not carry the day. Nominative fair use doctrine is rooted in First Amendment free speech principles. As a matter of policy, we probably don?t want to open the door to major corporations effectively undermining one of our holiest constitutional provisions by flexing their muscle via overzealous and arguably abusive demand letters that are (at least initially) contrary to the law. But the legal geek in me would love to see what would happen if these theories were ever actually tested in court.

Don?t Believe Everything You Read

Unfortunately, sloppy reporting (especially in the seemingly editor-less wilderness of the Internet) only perpetuates the confusion around these legal issues. It seems like every year, just as the airwaves are flooded with ?championship game?-themed advertisements, the newswires are flooded with people trying to explain the proliferation of those oblique Super Bowl non-references. For instance, yesterday,?Yahoo! Sports blog ?Shutdown Corner? explained that retailers are wary of referencing the Super Bowl by name because ?[t]he NFL is vigilant in protecting its copyrighted phrases,? but ?blogs like Shutdown Corner [can] refer to the Super Bowl without penalty? because ?[n]ews organizations are protected from copyright laws.?

Did you know that every time a reporter grossly misrepresents the law, somewhere, an overzealous lawyer gets a bonus? This reminds me of a game my fellow blogger Rachel Wilkes plays called ?How many gross misstatements of the law can you find in one paragraph?? Let?s try to unwind this disaster in 5 sentences or less (advance warning: lawyers invariably use every page, every minute, every word they?re allowed):

Copyright law protects creative works of expression, not commercial names or pithy slogans, and the phrase ?Super Bowl? is not ? and cannot be ? copyrighted. Trademark law protects commercial brand names, logos, slogans, and other elements that serve a source-identifying function in commerce, and?you better believe the phrase ?Super Bowl? is trademarked. News organizations?are subject to copyright law (trademark law, too) but get somewhat extra latitude to use material subject to intellectual property protection thanks to the First Amendment. But for the reasons stated above, pretty much everyone else who follows certain common sense guidelines should probably be able use the phrase ?Super Bowl? just as freely as dilettante bloggers. And finally, a pro-tip: if you?re looking for quality reporting on legal issues from non-legal outlets, look for?the ones that quote me.

So this Sunday, enjoy your Super Bowl party ? not your ?Big Game? party ? without fear or shame. I know I will.

Verizon details the impending Droid RAZR Android 2.3.6 update

Although it's not Ice Cream Sandwich update we're all waiting for, we've known for a while now the Droid RAZR was due for an update of some sorts -- and Verizon now has the details posted for all.

Applications:

  • Mobile Hotspot will now successfully allow other devices to connect to all Internet websites.
  • Improvements in the Mobile Hotspot security. + VZ Navigator® has been updated with the latest 3D map improvements.

Visual Voice Mail Updates:

  • Visual Voice Mail messages can be marked as read.
  • Visual Voice Mail message playback resumes when audio is switched to speaker.
  • Visual Voice Mail will successfully subscribe or unsubscribe while connected with Wi-Fi.
  • Successfully press back key after playback in Visual Voice Mail without error.

Data Connectivity:

  • Improved stability of data connectivity after Airplane Mode is disabled. + Improved data throughput performance in low-signal 4G environments.

Device Operation:

  • Improved Battery life when using Phone Book Access Profile (PBAP) Bluetooth® headsets.
  • Successfully save multimedia ringtones.
  • Favorite Contacts widget has been updated.
  • Improved device stability when moving between home screen panels.
  • Email icon has been updated for improved visibility.
  • When performing an Over the Air (OTA) update, the display will correctly show the remaining download time.
